1. Eligibility

You must be at least 18 years of age and capable of entering into legally binding agreements to use FamePBX services. By using the Service, you confirm that you meet these requirements.

2. Service Description

FamePBX provides hosted voice services, including Voice over IP (VoIP) communications, for businesses and individuals (“Services”). The Service enables voice calling, messaging, call management, and other communication features through IP-based technology. You agree to use the Service only for lawful purposes.

3. Acceptable Use Policy

You agree not to use the Service to:

Violate any applicable local, state, national, or international laws, including, but not limited to, the Federal Communications Commission (FCC) regulations.

Engage in any unlawful telemarketing, robocalling, or unsolicited communication that violates the Telephone Consumer Protection Act (TCPA), Truth in Caller ID Act, or other telemarketing and robocall laws.

Transmit harmful, defamatory, obscene, or offensive content via the Service.

Violate the privacy rights of others or engage in any activities that interfere with the use of the Service by others.

4. Compliance with FCC Regulations

By using FamePBX, you agree to comply with all applicable FCC regulations, including:

Truth in Caller ID Act (47 U.S.C. § 227): You will not alter or obscure the transmission of caller identification information in a manner that is misleading or deceptive.

Call Blocking Rules: You will not use the Service for the purpose of call blocking or to circumvent call blocking efforts implemented by carriers.

Robocall Regulations: You agree to comply with all rules regarding robocalling, including obtaining prior consent from individuals you contact through automated calls, as per the Telephone Consumer Protection Act (TCPA).

Telecommunications Relay Services (TRS): If applicable, you agree to support the use of Telecommunications Relay Services for individuals with disabilities, as mandated by the FCC.

5. Prohibited Activities

You agree not to engage in any of the following activities:

Call Spoofing: Falsifying or “spoofing” caller ID information in a way that is misleading or deceptive.

Unsolicited Communications: Engaging in unsolicited calls or messages that violate the Telephone Consumer Protection Act (TCPA) or Do-Not-Call Registry regulations.

Service Disruption: Attempting to disrupt, degrade, or interfere with the normal functioning of the Service, including hacking or any other form of unauthorized access.

Illegal or Fraudulent Use: Using the Service for illegal, fraudulent, or abusive activities, including calling party-line services, pyramid schemes, or telemarketing scams.

6. User Responsibilities

As a user of FamePBX, you are responsible for:

Ensuring that your use of the Service complies with all applicable laws and regulations.

Maintaining the security and confidentiality of your account credentials.

Promptly notifying us of any unauthorized access to your account or misuse of the Service.

7. Billing and Payment

You agree to pay all applicable fees for the Service, as outlined in your account plan. Billing will be in accordance with the terms of your agreement, and payments are due on a recurring basis (e.g., monthly or annually) as specified. Failure to make payments may result in suspension or termination of Service.

8. Suspension and Termination

We reserve the right to suspend or terminate your access to the Service for any reason, including:

• Violation of these Terms or any applicable laws or regulations, including those set forth by the FCC.
• Non-payment of any outstanding fees or charges.
• Engaging in any fraudulent or abusive activities.

In the event of termination, you may be required to pay any outstanding amounts due for Services rendered up until the date of termination.

9. Disclaimer of Warranties

The Service is provided on an “as-is” and “as-available” basis, without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, FamePBX will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless FamePBX, its affiliates, officers, employees, agents, and contractors from and against any and all claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any applicable laws or regulations.

12. Modifications to Terms

We may update these Terms from time to time. Any changes will be posted on this page with a revised “Last Updated” date. Your continued use of the Service after any such updates constitutes your acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the state of Texas, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in USA, Texas, for any dispute arising out of or relating to these Terms or the Service.
